Terms of service

By accessing or using SaliencyLab (the "Service"), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

If you disagree with any part of these terms, do not use the Service.

SaliencyLab is a pre-spend creative intelligence SaaS operated by Oussama Nakhil (sole proprietor, Morocco). The Service scores uploaded advertising creative against a 5-KPI rubric, surfaces benchmarks, and produces decision-support reports.

The Service is provided on an as-is, as-available basis. Scores are model predictions, not guarantees of in-market outcomes. See our Privacy Policy at /privacy and Security Overview at /security for detail on how data is handled.

You must provide accurate account information and keep your credentials confidential. You are responsible for all activity under your account. Notify us at contact@saliencylab.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these terms or pose a risk to other customers or the Service.

You retain ownership of all content you upload ("Customer Content"). You grant SaliencyLab a limited, worldwide, non-exclusive license to process Customer Content solely to provide the Service to you.

We do not sell Customer Content. We do not use Customer Content to train foundation models. We may use anonymized, aggregated statistics (for example, benchmark score distributions) to improve the Service, provided no identifiers are retained.

You agree not to use the Service in ways that are unlawful or that harm SaliencyLab, our users, or third parties.

• Do not upload content that infringes intellectual property or privacy rights of others.
• Do not use the Service for unlawful purposes or to process illegal content.
• Do not attempt to reverse engineer, decompile, or probe the Service for vulnerabilities outside our responsible disclosure process.
• Do not upload malware, exploit code, or content designed to disrupt the Service.
• Do not resell, rent, or white-label the Service without a separate written agreement.
• Do not scrape, crawl, or programmatically access the Service outside of documented APIs.

Paid plans are billed in advance on the applicable monthly or annual cycle through Stripe. Free plans are subject to usage limits published on the pricing page.

Cancellations take effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

We may change pricing with at least 30 days' notice for existing customers; changes apply at the next renewal.

RoastIQ scores, BuyerLens synthetic interviews, heatmaps, and recommendations are AI-generated outputs. They are decision-support tools, not measurements. They do not guarantee campaign performance, lift, conversion, or any downstream business outcome.

You remain responsible for your creative, media, and business decisions.

We ship new features behind feature flags. Features marked as "beta", "preview", or similar may change or be removed without notice and are provided without service-level commitments.

To the maximum extent permitted by law, SaliencyLab is not liable for indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost revenue, or loss of data, even if advised of the possibility.

Our total cumulative liability arising out of or related to these terms is limited to the amounts you paid to SaliencyLab for the Service in the 12 months preceding the claim.

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

You will defend and indemnify SaliencyLab against third-party claims arising from (a) your violation of these terms, (b) Customer Content you upload, or (c) your use of the Service in breach of applicable law.

Either party may terminate for convenience at any time via the in-product cancellation flow or by email to contact@saliencylab.com.

On termination, your access to the Service ends at the end of the current billing period. We will delete Customer Content within 30 days of termination, subject to legal retention obligations. Export your data before termination if you need a copy.

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Morocco, including the Moroccan Code des Obligations et des Contrats (Dahir of 12 August 1913, as amended).

The choice of Moroccan law does not deprive any consumer of protection granted by non-derogable provisions of the law of the country of their habitual residence (Article 6 of Regulation (EC) 593/2008 on contractual obligations, "Rome I"). In particular: EU/EEA consumers retain the protections of Directive 2011/83/EU on consumer rights, Directive 93/13/EEC on unfair terms, and their national implementing legislation; UK consumers retain the protections of the Consumer Rights Act 2015.

Primary forum: any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent commercial courts of Casablanca, Morocco.

EU/EEA consumers: notwithstanding the above, EU consumers may bring claims in the courts of their Member State of residence (Articles 17–19 of Regulation (EU) 1215/2012 "Brussels I recast"). EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

UK consumers: may bring claims in the courts of the part of the United Kingdom in which they reside.

Informal resolution first: before filing suit, the parties will attempt to resolve the dispute in good faith through written notice to contact@saliencylab.com and a 30-day negotiation period, except where injunctive relief is urgently required.

If you are a consumer (natural person acting outside of your trade, business, craft, or profession) in the EU/EEA, you have the right under Directive 2011/83/EU to withdraw from the contract within 14 days from the day of conclusion, without giving any reason.

However: SaliencyLab is a digital service. By commencing use of the Service (uploading a creative or launching an analysis) before the end of the 14-day withdrawal period, you expressly consent to the performance of the service beginning and acknowledge that you lose your right of withdrawal once the service has been fully performed (Article 16(m) of Directive 2011/83/EU). A prompt in the checkout flow makes this explicit at the time of order.

If you are not a consumer, for example, if you subscribe through a company account, the right of withdrawal does not apply.

SaliencyLab invoices include the TVA (taxe sur la valeur ajoutée) rate applicable under Moroccan tax law and the seller's fiscal identifier (ICE and IF). EU customers providing a valid VAT identification number may be subject to the reverse-charge mechanism; Stripe handles the reverse-charge invoice format where applicable.

We may update these terms. Material updates will be reflected on this page with a new "Last updated" date and, for paying customers, notified by email at least 30 days in advance where required.
